These Terms of Use ("Terms") are a binding agreement between you and Yomoyo LLC ("Yomoyo," "we," "us," or "our") governing your use of the Yomoyo mobile application, yomoyo.app, and related services (collectively, the "Service").
By downloading, accessing, purchasing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Yomoyo. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf. Do not use the Service if applicable law prohibits you from doing so.
2. The Service
Yomoyo is a Japanese reading and study application that provides reading content, dictionary and grammar references, vocabulary lists, flashcards, progress tracking, and game features. Features, content, availability, and Pro benefits may change over time.
Yomoyo is an educational aid, not a school, accredited course, translator, or professional language service. We do not guarantee fluency, test results, academic credit, or that every translation, definition, grammar explanation, tokenization result, reading, example, or difficulty label is complete or error-free.
3. Accounts and account connection
The app automatically creates an anonymous account identifier to save and synchronize your settings, learning activity, and game progress. You may optionally use Connect Account to add an email address and password to the current anonymous account. Connecting this way keeps the same Yomoyo account identifier and the progress already associated with it, and can allow you to access that account on another supported device.
If you instead sign in to an existing Yomoyo account, the app switches to the data associated with that existing account. Progress or other data from a separate anonymous account is not automatically merged or transferred. Before switching accounts, you are responsible for connecting any anonymous account whose non-purchase progress you want to preserve.
Account connection improves recoverability but does not guarantee that all data, progress, or purchase access can always be recovered. You are responsible for providing an email address you control, keeping your password confidential, securing your devices, and promptly notifying us if you believe your account has been compromised. Purchase restoration also depends on the applicable app-store account and subscription provider.
You may not sell, transfer, share, or misuse an account or attempt to access another person's account or data. Notify us promptly if you believe your account or purchase access has been compromised.
4. License to use Yomoyo
Subject to these Terms, Yomoyo grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for your own noncommercial learning and entertainment.
You may not:
- Copy, redistribute, sell, rent, sublicense, or commercially exploit the Service or its content.
- Reverse engineer, decompile, disassemble, scrape, extract, or attempt to obtain source code, databases, assets, or content, except where applicable law expressly permits it.
- Bypass access controls, subscription restrictions, rate limits, security systems, or technical protections.
- Use bots, scripts, automation, exploits, or unauthorized software to access the Service, manipulate progress, obtain rewards, or burden our systems.
- Interfere with the Service, introduce malicious code, probe vulnerabilities, impersonate another person, or use the Service unlawfully.
- Remove copyright, trademark, attribution, or proprietary notices.
5. Content and intellectual property
The Service, including its software, design, characters, artwork, animation, audio, text, selection and arrangement, and Yomoyo branding, is owned by Yomoyo or its licensors and is protected by intellectual-property laws. These Terms do not transfer ownership to you.
Some dictionary, kanji, grammar, tokenization, artwork, and other materials are provided under third-party licenses or with permission, including data from JMdict, KANJIDIC2, KanjiVG, Hanabira, Tanos JLPT resources, Sudachi and SudachiDict, and Tower Swap artwork. Applicable third-party rights, licenses, attribution requirements, and notices remain in effect and are available in the app's Attributions section.
Reading works remain subject to the rights of their respective authors, licensors, or public-domain status. Access through Yomoyo does not grant permission to reproduce or distribute a work outside the Service.
6. Yomoyo Pro subscriptions
Certain features may require an auto-renewing Yomoyo Pro subscription. The app will show the applicable price, billing period, included benefits, and any trial or promotional terms before purchase. Prices may vary by country, currency, platform, tax, and store account.
- Billing and renewal. Payment is charged to your Apple App Store or Google Play account. Unless canceled, an auto-renewing subscription renews for successive periods at the price shown by the store.
- Trials and promotions. If a trial or promotional period is offered, it converts to a paid subscription unless canceled before the deadline shown by the store. Eligibility is determined by the store and offer terms.
- Cancellation. You can manage or cancel through your Apple App Store or Google Play subscription settings. Uninstalling Yomoyo or deleting a Yomoyo account does not cancel a store subscription.
- Access after cancellation. Unless the store or applicable law provides otherwise, cancellation takes effect at the end of the current paid period.
- Refunds. Purchases and refund requests are governed by the policies of the store that processed the transaction and applicable law.
- Price or benefit changes. We may change subscription pricing or benefits for future periods. The store will provide notice and request consent when required. You may cancel before a change takes effect.
Subscription status is managed through RevenueCat and the applicable app store. We do not directly receive or store your full payment-card number.
7. Feedback and support communications
If you send ideas, suggestions, or feedback, you grant Yomoyo a worldwide, perpetual, irrevocable, royalty-free right to use, modify, and incorporate that feedback without compensation or obligation to you. This does not give us ownership of personal information contained in a support request, which is handled under our Privacy Policy.
8. Third-party services
The Service relies on or may link to third-party platforms, stores, infrastructure, libraries, and websites. Your use of those third-party services may be governed by separate terms and policies. Yomoyo is not responsible for third-party services outside our control.
Apple, Google, and other app-store providers are not responsible for maintaining or supporting Yomoyo except as required by their own terms or applicable law. If you downloaded Yomoyo from an app store, you also agree to that store's applicable usage rules.
9. Changes, interruptions, and availability
We may add, modify, suspend, limit, or discontinue features, content, game balance, rewards, dictionaries, reading works, or portions of the Service. We do not guarantee that the Service or any particular content will always be available, uninterrupted, secure, or compatible with every device.
We may perform maintenance, enforce limits, correct errors, remove content for legal or licensing reasons, and update the Service automatically where your platform permits. We are not responsible for failures caused by your device, internet connection, app store, or third-party provider.
10. Suspension and termination
You may stop using the Service at any time. You may request deletion as described in our Privacy Policy and on our Delete account page. Store subscriptions must be canceled separately through the store.
We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or if suspension is required to protect the Service or others. Where appropriate, we will provide notice and an opportunity to contact support.
Sections that by their nature should survive termination—including intellectual property, disclaimers, limitations of liability, indemnity, and dispute terms—will survive.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." YOMOYO AND ITS LICENSORS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS; THAT CONTENT OR LEARNING RESULTS WILL BE ACCURATE OR COMPLETE; OR THAT DATA OR PROGRESS WILL NEVER BE LOST. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOMOYO AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, PROGRESS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOMOYO'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO YOMOYO THROUGH THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
These limitations do not limit liability that cannot lawfully be excluded or limited, and they do not affect mandatory consumer rights.
13. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Yomoyo and its owners, officers, employees, contractors, and licensors from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from your unlawful use of the Service, your material violation of these Terms, or your violation of another person's rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent the laws of your place of residence provide mandatory consumer protections that apply. Any dispute that is not subject to a mandatory local forum will be brought in a court of competent jurisdiction in Colorado, and you and Yomoyo consent to that court's jurisdiction.
Before filing a formal claim, please contact support@yomoyo.app so we can try to resolve the issue informally. Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief.
15. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, or our practices. We will post the updated Terms and revise the date above. If a change is material, we will provide additional notice when required. Your continued use after updated Terms take effect constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Service and cancel any subscription.
16. General terms
These Terms and the Privacy Policy are the entire agreement between you and Yomoyo regarding the Service, except for additional terms presented for a specific feature or purchase. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
